Terms & Conditions of Service
If you are having printing carried out by Elasnik Print & Design, please read the terms and conditions below before ordering. These apply to all orders, no matter how big or small.

If you have any questions in regard to the products then please feel free to call us and talk to one of our team who will be able to answer any questions prior to placing an order.


Definitions

THE CLIENT: The company or individual requesting the services of Elasnik Print & Design

General

Elasnik Print & Design will carry out work only where an agreement is provided either by email, postal mail or signature. An ‘order’ is deemed to be a written or verbal contract between Elasnik Print & Design and THE CLIENT; this includes quotes, telephone, signature, mail and email agreements.

Quotes

All quotes that are prepared are valid for 30 days only. A quote is not a contract with Elasnik Print & Design print design. Prices are subject to change.

VAT

All prices, unless explicitly expressed, are excluding vat at either 21.5% or 13.5% (depending on the nature of the job). Negotiations on VAT are not entertained upon final payment of bill.

Delivery & Payments

Printing turnaround will vary. The current median turnaround time for most printing products is 10 business days. This is not a guarantee but a guide. This is from the time receiving payment and accepting the proof, to the time when you receive your order. Design time is extra. It is the customer's responsibility to allow plenty of time for preparing artwork, printing and delivery.

For custom jobs, we will provide you with a lead time once the project has being researched from our side. Please note: Lead times are not set as they depend on the physical workload at the time. If you require your order urgently, please tell our designers when you place your order & we will do our best to accommodate you.

A 50% deposit is required with any project before any design/print work will be carried out. The final 50% payment is due upon completion/collection. Under no circumstances are there any price adjustments to be made on the customer’s behalf once a quotation or job has been previously agreed. No exceptions. We accept cheque, credit/debit cards and cash.

In addition:
  • These services rely on the customer not delaying the progress of the order in any way (which delays include but are not limited to the customer not returning proofs by the time specified by Elasnik Print & Design or failing to make payment by the time such payment is due) (a “Customer Delay”). In the event of a Customer Delay the customer shall not be awarded a Credit and the customer shall still be obliged to pay the Premium Charges but the printing.com reseller shall not be bound to deliver within the Guaranteed Period.
  • Delivery of work by Elasnik Print & Design shall be deemed to take place upon collection of the work by the customer (where the customer is obliged to collect the work) or (where Elasnik Print & Design is obliged to deliver the work) actual delivery of the work to the customer by Elasnik Print & Design. Where the customer is obliged to collect the work, customer’s failure to collect the work on the day on which the Elasnik Print & Design is contractually obliged to have it ready for collection shall be classed as a Customer Delay. Where Elasnik Print & Design is obliged to deliver the work to the customer but the customer provides Elasnik Print and Design with incomplete or incorrect delivery information or is not available to accept delivery, then provided that Elasnik Print & Design has used reasonable endeavours to deliver the work to the customer, a failed delivery shall be classed as a Customer Delay.
  • Unless otherwise specified the price quoted is for collection of the work from Elasnik Print & Design, Market Square, Kinsale, Co. Cork. A charge may be made to cover any extra costs involved for delivery to a different address.
  • Should expedited delivery be agreed Elasnik Print & Design shall be entitled to make additional charges on a time and materials basis to cover any overtime or any other additional costs involved, including without limitation, the cost of couriers or special delivery post.
  • Should work be suspended at the request of or delayed through any default of the customer for a period of 30 days or more Elasnik Print & Design shall then be entitled to payment for work already carried out, materials specially ordered and other additional costs including storage.
  • Risk of loss of or damage to work completed by Elasnik Print & Design shall pass to the customer on delivery. Notwithstanding delivery and the passing of risk in the work to the customer, ownership of and title to the work shall not pass to the customer and shall be retained by Elasnik Print & Design until Elasnik Print & Design has received payment in full in respect of the work.
  • In the unlikely event that Elasnik Print & Design deems it necessary to re-print work, the agreed lead time shall recommence from the time of Elasnik Print & Design confirmation to the customer of its agreement to reprint the work.


Design Charges

These are for all and any design time that has our designers occupied. This includes any experimental work.

Preliminary Work

All work carried out, whether experimentally or otherwise, at a client’s request shall be chargeable.

Company Imprint

Unless otherwise specifically requested in writing any work may carry the Elasnik Print & Design imprint which will be positioned at our discretion.

Submission of Artwork or Graphics

If you are supplying art work to Elasnik Print & Design, print ready, all must be set up with appropriate bleeds of .5cm, be in PDF or AI format and be of 300 dpi resolution in CMYK colour mode.

Files we do not accept as "artwork ready":
Word Documents
Publisher Documents
PowerPoint Documents
Pieces of Paper


A design charge applies to all jobs without proper artwork. See Design charges above.

Images, designs & artwork must be submitted in CMYK format. Elasnik Print & Design cannot be held responsible for any colour shift that may occur in conversions to CMYK. Customer provided artwork may vary in quality, therefore, Elasnik Print & Design cannot be held responsible for pixelated, blurry or distorted images.

Submission of DIY artwork

Please note that designing and submitting your artwork for printing can sometimes produce unplanned results. Designing artwork for offset printing can be technical with a range of factors that goes beyond what you see on the computer monitor. Elasnik Print & Design fully recommends getting a professional designer to design your printing artwork. Customers submitting their own DIY artwork are fully responsible for the end result of printing. Customers are reminded to submit print-ready artwork with the correct specifications as outlined on our Submission of Artwork or Graphics guidlelines.

You will receive a free artwork proof by email which you will need to approve before printing can commence. Elasnik Print & Design will print whatever you submit, and Elasnik Print & Design is not responsible for artwork mistakes. No reprints at our expense will be printed.

It is your responsibility to ensure that any artwork that is submitted is not in violation of any copyright laws. Elasnik Print & Design assumes that your artwork is legally yours or you have the correct permission to print it.

Elasnik Print & Design reserves the right to make changes to your artwork without your consent to avoid printing problems that can be foreseen to happen. This will rarely change the design, but if it does it will be evident in the proof you receive. If after viewing your email proof you would like to resubmit your DIY artwork, we will send you a new proof for €20.00. Alternatively we can make your requested changes for you from €20.00 and then email you a new proof.

Customers Content

Elasnik Print & Design take no liability for content supplied which may infringe on any copyright or trademark laws. If you decide to plagiarise someone else’s work for the benefit of your business, you do so at your own risk. All content, both written and visual, must be supplied to us on digital format only – email, disk, memory key etc. A charge of €10.00 applies for A4 pages of tying (double side). A charge of €2.00 applies to all pictures for scanning.

Accepting Proofs

When accepting artwork proofs from Elasnik Print & Design, you are held fully responsible for accepting all content. This includes design, layout, spelling, grammar and numbers. It is your responsibility to request another copy if your proof is difficult to read. Elasnik Print & Design will print exactly what is accepted in the final proof. No reprints at our expense will be printed.

You will receive one free proof for each order. Proofs provided by Elasnik Print & Design are an indication of the final printed product only. Variations in colour or trim can be a result of the printing process. No reprints at our cost will be printed. Customers should read and follow our Submission of Artwork or Graphics guidelines carefully before submitting their artwork.

All artwork for print, once designed, must be proofed by the client. The proofing process confirms the following:

Spelling – we do not accept responsibility for spelling mistakes
Design – No elements of design can be changed once sent to print
Quantity – When proofing, we ask the client to confirm the quantities for order.

DIY Artwork Proofs

If you would like to make changes to your DIY artwork after viewing the proof, you may resubmit your updated artwork to receive a new proof for €20.00. Alternatively we can make your requested changes for you from €20.00 and then email you a new proof.

All artwork for print, once designed, must be proofed by the client. Elasnik Print & Design will not accept responsibility for any client errors occurring in the following:

Spelling
Typeographical Errors
Grammar
Punctuation
Graphics
Fonts
Content
Quantity


Elasnik Print & design will not be held responsible for client errors in finished product sizes, wrong cuts, or missing or incorrect folds.

We accept an email or a completed ‘sign-off’ sheet as confirmation of proof. No refunds or reprints are given after a final approved design has gone to print. Please read all text carefully as Elasnik Print & Design will not be liable for spelling mistakes or omitted information.

Colour Variations

Our printing products may have colour variations from what you have seen on screen, to what the final product looks like, variations between the front and back of the card, and previous orders can also be expected. This is the nature of CMYK offset printing and bulk-run printing.

Digital printing may also produce some "blotchy" effects which is the nature of express digital printing.

Elasnik Print & Design cannot be held responsible for matching colours or ink densities on screen proofs approved by customers. Screen proofs can be used to help display layout, text accuracy, and image placement and proportion, but not colour or density.

Elasnik Print & Design will make every effort to match the density of each colour, however we cannot be held responsible for the final appearance of a colour. The appearance of printed colours may be affected by UV coating, and other various elements therefore, Elasnik Print & Design cannot be held responsible for final colour of UV-coated products. No reprints at our expense will be printed.

Delivery

All our prices for printed products are for collection from our office. For goods delivered directly to customers homes/premises, courier charges apply, which are calculated upon order. Returns are customer’s responsibility.

Print Over Run

From time to time, print over run does occur on a print job. In these cases, we may contact you to offer the additional prints at a discounted rate. You are under no obligation to accept these; however, they are generally priced very well.

Time Lines

Once a client has paid a deposit for a printing job, the client has a maximum of 1 week to get the content to us. Any longer delays than this will result in a cancellation of the project and a charge, to be deducted from the deposit, for time wasted.

If a set deadline is agreed upon between Elasnik Print & Design and the client, the client must make available all materials and content, as soon as is reasonably possible.

Claims

All claims or issues with print orders must be reported to Elasnik Print & Design within 3 days of receipt of order (or within 28 days of non-receipt of order). If you have accepted an order and discovered there is a problem, contact us immediately. If you have used the product, then decide a few days in, with stock used, that there is an issue; there is nothing we can do for you.

If there has been a problem with the print that concerns the quality of the print, the condition of the printed goods or wrong specifications as agreed, Elasnik Print & Design will have a re-print ordered.

Elasnik Print & Design is not responsible for spelling mistakes or design issues, once the job has been proofed. (See Proofs) 

Order Cancellation

Prior to approval, Elasnik Print & Design allows customers to cancel print orders. Any design work carried out by Elasnik Print & Design up to this point will be charged accordingly. We will inform you of any charges depending on the stage of the order. Cancellation fees will be calculated based on the age of the order. Orders placed without proofs cannot be cancelled.

Refunds

Client orders have no re-sale value. Therefore, ALL SALES ARE FINAL. Once a project has been designed in full according to the agreed upon project, no refunds are given after design has been approved. If more than the agreed upon number of layouts is provided along with revisions no deposit is refunded. Refunds for shipping and printing are not given.

Trimming of Printing

All printing products are trimmed. Trimming of printing products may shift up to 3mm in any direction, therefore our Submission of Artwork or Graphics guidelines should be properly adhered to minimize risk of trimming affecting the look of the print. Borders near the edge of artwork are not recommended as shifting in trimming may cause borders to look uneven. No reprints at our cost will be printed.

Ownership of Artwork & Copyright

Copyright of designs by Elasnik Print & Design remains the property of Elasnik Print & Design until paid for by the Customer. Once paid for in full, copyright ownership is transferred to the Customer.

Artwork collected or designed by Elasnik Print & Design remains the property of Elasnik Print & Design. Elasnik Print & Design is under no obligation to provide copies of artwork to Customers, unless it is specifically included on the Customer's invoice from Elasnik Print & Design. Elasnik Print & Design is under no obligation to store artwork for Customers. Elasnik Print & Design may charge the Customer to retrive, prepare and send artwork to Customer's when requested, but it is at Elasnik Print & Design's discretion to do so.

Elasnik Print & Design Designed Artwork

Every printing order comes with one free proof, which is emailed to the Customer. Printed proofs can be provided if requested. One additional proof is provided free of charge, should the customer require any changes. Extra proofs with changes to the design are available for €20 each.

Any future orders of the same printing product with the exact same artwork, and no alterations needed, also come with one free proof. Elasnik Print & Designs design services can take up to 7 working days, and turnaround will vary depending on workload. Outstanding balances owed for design services not paid within 30 days will be automatically debited from the customer's credit card. Customers are held liable for expenses incurred by Elasnik Print & Design in recovering debts.

Shipping & Delivery

Elasnik Print & Design will strive to ensure all orders are produced & delivered on time, however, we will not be held responsible for any consequences or damages due to delayed production or delivery. Elasnik Print & Design will not be held liable for printing products that are lost, damaged or delayed when delivered by post or courier. Elasnik Print & Design will not be held responsible for delays in shipments due to international customs issues, weather conditions or any other circumstances beyond our control.

All deliveries will be left at the address in the event of no one being present to sign for delivery. It is the Customer's responsibility to ensure a safe address is provided for delivery.

Prices

Elasnik Print & Design has the right to remove or change products and prices without notice. All quotes are valid for 30 days only and may be subject to change after this period.

Disclaimer

Elasnik Print & Design will not be liable for costs incurred, compensation or loss of earnings due to the failure to meet agreed reasonable deadlines.

Elasnik Print & Design will not be liable or become involved in any disputes between Elasnik’s Client and their clients and cannot be held responsible for any wrongdoing on the part of a customer.

Elasnik Print & Design will not be liable for any costs incurred, compensation or loss of earnings due to the work carried out on behalf of THE CLIENT or any of THE CLIENTs appointed agents.
